While hearing the case, the bench of Judge Krita Bahadur Bohra has ordered to send the rest of the proceedings to the Consumer Court, Tripureshwar. It has also been ordered to deduct the costs from the district court and send the entire missile to the consumer court.
24-year-old Vidya Rana of Chitwan gave birth to twins within a minute of each other at Karuna Hospital on the night of 24th June 2081. Both babies, who were born in normal conditions, were kept in the neonatal intensive care unit (NICU) by the hospital.
According to the victim’s family, initially the condition of both the babies was normal, but the mother was not allowed to breastfeed. The first baby, who was to be discharged on June 27, was given antibiotics the same night because of sleep apnea. According to the family, Naito performed a small operation and gave medicine after no veins were found in the limbs.
After Naito’s surgery, the family took the first child to the Trivi Teaching Hospital, Maharajganj, on June 29, when the condition of the first child became critical. The doctor there said that the first baby was suffering from excessive internal bleeding. He died on June 31 during treatment.
On the other hand, the family said that the second baby kept in Karuna Hospital also died on the morning of June 30 due to internal bleeding.
After losing both their children within a week, Vidya and her husband Pradeep Bhatt are seeking justice against the negligence of the hospital and doctors. After the incident, they filed a complaint with Nepal Medical Council, Police Circle Maharajganj, District Administration Office, Ministry of Health and Prime Minister’s Office.
The victim’s family has been alleging that the hospital unnecessarily kept the baby in the NICU and committed serious technical negligence during treatment for the purpose of recovering money. The case of compensation related to this incident will now proceed to the consumer court.
